The Colorado Governmental Immunity Act Limits Liability

The law limits the maximum amount that can be recovered if you are injured in an accident caused by a governmental employee.

“For any injury to one person in any single occurrence,” the maximum is $150,000.

“For an injury to two or more persons in any single occurrence,” the amount is $600,000, however no one person can recover more than $150,000.

When you’ve been injured in a motor vehicle accident, your legal rights make it possible for you to pursue compensation from the individual who caused the crash. That can include payment for your medical care, replacement of lost wages and consideration for your pain and suffering. Generally, you can seek the amount of compensation that is necessary to return you to your former state of well-being. You may also be able to recover punitive damages. However, if the accident in which you were injured was caused by a government employee, the rules are different. Consult an experienced accident attorney for advice about the Colorado Governmental Immunity Act.

The Colorado Governmental Immunity Act (CGIA) was designed to limit the liability of government entities. It provides immunity from many kinds of lawsuits, and applies to to the State of Colorado, state subsidiaries (including colleges and universities), special districts, counties, and municipalities. There are, however, situations in which that immunity is waived, enabling injured individuals to take action against the governmental entity involved. Among those instances are motor vehicle accidents caused by a city, county or state employee who is carrying out his or her job duties.
In pursuing compensation under the CGIA, procedures differ from those that apply if you’ve been injured by a private citizen. There is a time limit within which you must file a claim. Ordinarily, that time limit is three years, but in CGIA cases you must act within 180 days or forever forfeit your right to seek compensation. This administrative claim must be made in writing and directed to the governmental agency that employs the individual who struck you.

Guidelines specify the information that must be included in the claim. Before a lawsuit can be filed, you must await the first of either 90 days’ passing or the governmental entity’s denial of your claim. The CGIA also places limits on the amount of damages you can receive for your injuries, and makes the government immune from paying punitive damages.
