Colorado lawmakers have declared dangerous dogs to be a serious threat to the public’s safety, and they’ve enacted legislation to address the hazard vicious animals pose. Further, the statute that speaks to dangerous and vicious dogs includes situations where such animals harm other pets. If you or a loved one has been injured by a dangerous or vicious dog – or if a dangerous dog has hurt or killed your pet, contact a qualified personal injury attorney for advice.

The Colorado dog bite injury attorneys at the Law Firm of Jeremy Rosenthal have the experience and the professional knowledge to investigate the attack that left you injured. We can determine whether the dog that attacked you is dangerous or vicious. Our seasoned personal injury lawyers can also determine the dog owner’s liability for your injuries. Dangerous or vicious dogs are likely to inflict serious harm. Indeed, they are responsible for deaths of both humans and domestic animals. When you’ve been severely injured, you need an attorney who will tirelessly work to protect your rights and to hold the owner of a vicious dog responsible for the harm inflicted by the animal. You’ll find attorneys with that tenacity and determination at our firm.

While some people automatically condemn specific breeds as dangerous or vicious, such a designation actually rests on a number of factors, such as a dog’s size, weight, temperament, training and quality of care. Colorado Statutes define a dangerous dog as one that:

  • Inflicts bodily injury or serious bodily injury on a person or domestic animal, or that causes the death of a person or domestic animal.
  • Demonstrates tendencies that would lead a reasonable person to think it capable of seriously injuring or killing a person or domestic animal.
  • Is trained to or does take part in prohibited animal fighting.

The statute governing dangerous dogs goes on to specify a number of potential penalties that will apply to the owners of such dogs in the event that the animals cause injuries or deaths to people or other animals. Among the provisions the law makes is restitution to the owner of a domestic animal that suffers injury or death, and that restitution includes “reasonable and necessary medical expenses incurred in treating the animal.”

Demonstrating the state’s commitment to ensuring that the owners of dangerous dogs are held to high standards of responsibility, Colorado lawmakers have mandated that such animals be permanently identified. This is done by requiring owners to microchip their dogs and to pay a “dangerous dog microchip license fee.” A number of other conditions of ownership are spelled out in the statutes, as well.
