Colorado law is written “to promote a state policy of responsibility by both landowners and those upon the land as well as to assure that the ability of an injured party to recover is correlated with his status as a trespasser, licensee, or invitee.”

Colorado Statutes underscore lawmakers’ desire to promote safe conditions on property within the state, and to hold owners responsible when a person is injured because the owner failed to maintain safe conditions on the premises. However, the liability of a property owner is affected by the victim’s standing. The state specifies three types of visitors to property: invitees, licensees and trespassers.

As the name suggests, an invitee is someone who has been invited onto property. The law specifies that the invitee “enters or remains on the land of another to transact business” which benefits them both, or is on the property “in response to the landowner’s express or implied representation that the public is requested, expected, or intended to enter or remain.” A customer visiting a business is an example, so is a diner at a restaurant, or a client at a beauty salon. In terms of liability, the owner of a business or commercial establishment is viewed as having a duty to “exercise reasonable care” to prevent invitees’ being exposed to dangers on the property.

The statutes define a licensee as “a person who enters or remains on the land of another for the licensee’s own convenience or to advance his own interests, pursuant to the landowner’s permission or consent.” The designation includes “a social guest.” Property owners who fail to warn licensees about dangers on the property may be held liable for injuries the licensee suffers as a result of that danger.

A trespasser is defined as “a person who enters or remains on the land of another without the landowner’s consent.” Colorado law affords trespassers the least amount of protection when it comes to premises liability, specifying that such a person may only recover for “damages willfully or deliberately caused” by the property owner.
